Terms of Use

These Terms of Use (the "Terms") govern your use of the Logmiles app for iOS and this website (the "Service"), provided by Setout Labs. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, and have the legal capacity to enter into a binding agreement with Setout Labs. You agree to use the Service in compliance with these Terms and all applicable law.

2. Accounts and security

If you create an account, provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Tell us at support@logmiles.co if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.

3. Mileage records are not tax advice

Logmiles produces mileage records, coverage summaries, and estimated deductions from GPS capture and from entries you make or confirm. These are informational estimates, not tax, accounting, or legal advice, and they are not a substitute for a professional. Automatic capture can miss or misjudge drives, which is why the app shows gaps for you to repair, and reconstructed past-year entries are estimates you must review and attest to yourself. Reports are localized for the United States, Canada, Australia, and the United Kingdom; you are responsible for the accuracy and completeness of the records you file, and for confirming the rates and rules that apply to you with a qualified tax professional or your tax authority.

4. Free tier, trial, and subscription

Manual trip logging, editing, and CSV export are free with no trip caps. Automatic background tracking and the tax-ready PDF report require a paid subscription, and a 7-day free trial of those features starts automatically on first run with no card and no payment sheet. When the trial ends, your trips stay in your log and the free features keep working. Subscriptions are sold through the Apple App Store, which controls billing, refunds, and its own terms alongside these Terms. A subscription renews automatically at the end of each billing period at the then-current price until you cancel in your App Store settings; cancellation takes effect at the end of the current period. We may change prices with notice, effective the next billing period. Taxes may be added and vary by location. Refund requests are handled by Apple.

5. Your content

You retain all rights you hold in the content you create, upload, or store in the Service (your "Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your Content solely to operate and provide the Service to you. You are responsible for your Content and for ensuring it does not infringe anyone's rights. We may remove Content that violates these Terms or applicable law.

6. Acceptable use

You agree not to:

  • Use the Service unlawfully, harmfully, fraudulently, or in a misleading way.
  • Upload malicious code or otherwise disrupt or overburden the Service.
  • Attempt unauthorized access to the Service, other accounts, or our systems.
  • Reverse engineer or extract source code, except where the law expressly permits it.
  • Misrepresent your identity or your affiliation with any person or organization.

7. Intellectual property

Except for your Content, Setout Labs owns all rights in the Service, including its software, design, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. Third-party services

The Service relies on third parties including Apple, cloud hosting, and error and analytics providers. Those services are governed by their own terms and policies, and we are not responsible for them.

9. Termination

You may delete your account at any time from the app's settings or by contacting support. We may suspend or terminate your access for material or repeated breaches of these Terms, security risks, or where the law requires it. Provisions on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that its output will be accurate or fit any particular purpose. To the maximum extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing here excludes warranties that cannot be limited by law.

11. Limitation of liability

To the maximum extent permitted by law, Setout Labs is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service or these Terms will not exceed the greater of the amount you paid us in the 12 months before the claim or fifty U.S. dollars (USD $50). Some jurisdictions do not allow these limits, in which case they may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Setout Labs and its affiliates, officers, employees, and agents from any claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, your Content, your violation of these Terms or applicable law, or your infringement of a third party's rights.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory local law applies. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute, except where local law permits you to bring an action where you live. Nothing here limits your consumer-protection rights.

14. Changes

We may update these Terms as the Service or the law changes. For material changes we'll give notice in the Service or by email before they take effect, and we'll revise the date above. Continuing to use Logmiles after changes take effect means you accept the revised Terms.
